Daby Humbert - 3 - 16 April 2013 <br /> Zacky & Sons Poultry, LLC <br /> We appreciate your efforts in initiating the RWD process and understand that current facility <br /> ownership may need time to evaluate the option of continued use or replacement of the pond <br /> before responding to the information requested in this letter. To this end, Zacky & Sons Poultry <br /> LLC shall comply with the following response schedule: <br /> By 1 July 2013, Zacky & Sons Poultry LLC shall submit a written response to this letter <br /> indicating whether the wastewater pond will continue to be used, or replaced with <br /> another pre-treatment alternative. If the pond will be abandoned, a meeting should be <br /> arranged to discuss proposed facility modifications and pond closure. <br /> • If Zacky & Sons Poultry LLC intends to continue using the wastewater pond, the <br /> following actions are required: <br /> a. By 30 August 2013, the results of pond liner testing shall be submitted. <br /> b. By 13 September 2013, a Groundwater Monitoring Well Installation Report shall be <br /> submitted. The report shall include the results of at least one round of monitoring <br /> well sampling and analysis. <br /> c. By 30 January 2014, a Report of Waste Discharge shall be submitted. If liner <br /> testing results indicate that the liner is leaking, the Report of Waste Discharge must <br /> also include a plan and schedule for liner replacement and a Construction Quality <br /> Assurance (CQA) Plan. <br /> Once the RWD is determined to be complete, we will schedule permit development. The <br /> permitting process includes a 30-day public review of draft (tentative) WDRs and a public <br /> hearing by the Central Valley Water Board. Due to limited state resources, you should allow at <br /> least twelve months from submittal of a complete RWD to adoption of WDRs. <br /> This request is made pursuant to California Water Code Section 13260(a).
