This information was required to be submitted by 3-9-10. This information was not <br /> received until 4-1-10 resulting in a non-compliant status for this facility. An operator that receives an inspection <br /> report shall have 30 days to submit a written response that includes a statement documenting corrective actions <br /> taken or proposing corrective actions which will be taken. Ensure that a written response documenting corrective <br /> actions taken or proposed is submitted within 30 days of receiving an inspection report. This is a Class II violation. <br /> 117 HSC 25404(e)(4) Failed to report program data electronically. <br /> A submission to the California Electronic Reporting System (CERS) for the hazardous waste program has not been <br /> made. Beginning January 1, 2013, all businesses are required to submit all new (or any changes to existing) <br /> hazardous waste information online to the CERS at http://cers.calepa.ca.gov. Be sure to include your hazardous <br /> waste activity in the Businesses Activities section in CERS in addition to any other relevant activities and required <br /> fields. This is a Class II violation. <br /> 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br /> Dark and wet oil stains were observed on the outside lots to the north and west of the shop. These dark and wet oil <br /> stains were underneath the transport truck, near the transmission, and near the used tires. More dark and wet oil <br /> stains were found inside the shop near the full size pick up truck. Facilities shall be maintained and operated to <br /> minimize the possibility of a fire, explosion, or release of hazardous waste to air, soil, or surface water which could <br /> threaten human health or the environment. Immediately clean up any spilled vehicle fluids, and manage according <br /> to Title 22 hazardous waste regulations. Submit a statement and supporting documentation explaining how this <br /> waste was managed. This is a repeat violation, Class II. <br /> 601 CCR 66262.34(d) Stored hazardous waste onsite greater than 180 days. <br /> The hazardous waste storage area is located inside the north end of the shop. There are three 55 gallon drums <br /> containing used oil and one 55 gallon drum containing used antifreeze. Jesse Downer confirmed that he has not <br /> been able to get anyone to pick up his used oil and used antifreeze within the past three years. This waste has been <br /> on site longer than 180 days. Facilities who generate less than 1000 kg of hazardous waste per month and do not <br /> exceed 6000 kg of waste stored on site at any time may store waste on site up to 180 days. Immediately contact a <br /> licensed hazardous waste hauler to dispose of this waste under manifest and submit a copy of the manifest to the <br /> EHD.
