Quarterly Report - 152 East 11th Street, Tracy Page 4 <br /> Remediation <br /> To implement the remediation described in the amended corrective action plan, it will be <br /> necessary to demolish the existing building and associated structures on the 152 East 1 lth <br /> Street site Planning for that work has begun and demolition has been tentatively <br /> scheduled for late November 1995 <br /> Petroleum Underground Storage Tank Cleanup Fund Application <br /> The accounting and clerical work necessary to prepare and maintain the cost data and <br /> documentation required for periodic submittal of Standard Form Payment Requests under <br /> the Petroleum Underground Storage Tank Cleanup Fund in compliance with the <br /> CSWRCB's administrative rules is ongoing <br /> To ensure that the necessary cash flow will be available to finance the planned <br /> remediation, on November 21 st 1995 (i e following the close of the reporting period that <br /> is the subject of this document) a request for funding that included a copy of the amended <br /> corrective action pian and the associated engineer's cost estimate was prepared and <br /> submitted to the CSWRCB (Note An estimate of the likely cost of remediation was <br /> included in the original application for funding under the Petroleum Underground Storage <br /> Tank Cleanup Fund that was submitted in 1993, but the CSWRCB did not specifically <br /> allocate sufficient funds to cover the cost of any portion the remediation when the initial <br /> application was approved ) <br /> Search for Dischargers Responsible for Release of Hydrocarbons <br /> The Navarras purchased the 152 East 11th Street Property in December 1978 Since that <br /> time, no fuel dispensing or other operations have been conducted on the site that could <br /> account for the contamination that has been found in the subsurface <br /> The owners of the site immediately prior to its purchase by the Navarras were The San <br /> Diego Armour Oil Company Inc and associated parties That company, and other pnor <br /> owners, operated an automobile service station on the site and operated the underground <br /> storage tanks from which gasoline leaked into the subsurface <br /> The San Diego Armour Oil Company has been effectively unresponsive to <br /> communications by either the CSWRCB Division of Clean Water Programs or the <br /> SJCPHS that have both requested that company to meet its responsibilities under the <br /> applicable regulations to investigate and remediate the contamination found on the <br /> property and to pay regulatory oversight fees <br /> The Navarra's attorneys have filed a complaint against the San Diego Armour Oil <br /> Company and associated entities in California Superior Court Further action with respect <br /> to that litigation will depend upon the schedule of the Court or any action by San Diego <br />
