Quarterly Report - 152 East 11th Street, Tracy Page 7 <br /> (which has heretofore been equitably distributed between the parties) to the Navarras and <br /> . require them to sign a revised agreement that included clauses that could be interpreted to <br /> mean that the Navarras would agree to be held liable for contamination that has been <br /> found under Ultramar's 15 3 East Street property On the advice of legal council, the <br /> Navarras declined to agree to the revised terms for technical cooperation demanded by <br /> Ultramar and the previously extant arrangements have been discontinued <br /> WORK IN PROGRESS <br /> The following work is in progress <br /> Corrective Action Plan <br /> The Navarras have authorized their consulting engineers, The San Joaquin Company Inc , <br /> to proceed with the development of a Corrective Action Plan (CAP) for remediation of <br /> the 152 East 11th Street property A pump test to investigate the hydrogeologic <br /> properties of the soils beneath the site is currently scheduled for December 1993 It is <br /> expected that a CAP will be available for review by the SJCPHS by April 1994 <br /> Groundwater Quality Monitoring <br /> . Following the comprehensive round of sampling of all monitoring wells in the combined <br /> array instaled for the 152 and 153 East 11th Street sites, the Groundwater SamplingP <br /> lan <br /> - Property at 152 East I I th. Street, r calls for future rounds of sampling of <br /> selected wells to be scheduled for the annual wet and dry seasons The next sampling <br /> round is scheduled for February 1994 <br /> Search for Dischargers Responsible for Release of Hydrocarbons <br /> The Navarras have instructed their attorney, Jerry D Hall Esq , to initiate a search to <br /> determine the addresses and legal status of the several entities that owned and operated <br /> fuel dispensing facilities and service stations at the 152 East 11th Street site prior to its <br /> ownership by the Navarras Those entities include the San Diego Armour Oil Company <br /> from whom the Navarras acquired the site <br /> Prior owners of the site are known to have operated fuel dispensing facilities at the site <br /> and one or more of them must have discharged the hydrocarbons found in the subsurface <br /> because the Navarras have never operated any facilities involving use of fuel hydrocarbons <br /> or similar materials on the property The staff of the SJCPHS have indicated that they also <br /> are researching the current status of the San Diego Armour Oil Company <br />
