i <br /> Sampling Plan- 152 East I Ith Street, Tracy, CA Page 6 <br /> I <br /> that were located on the Tracy Auto Parts site, or from any of the several other potentia <br /> • sources of petroleum product discharge on close-by sites up and down 11th Street ate., = r"!� <br /> It is important to understand that the interpretation shown on Figures 2 is not intended to - •�" <br /> be definitive It was developed solely as an aid to understanding of the availabI k U <br /> geotechnical data and for the purposes of planning further investigations of subsurface and; ¢ 7",- <br /> water <br /> ,-water quality conditions The presentation should not be used as a definitive basis foto X11 UJ <br /> determining the precise hilts of any hydrocarbon fuel components affecting the �- <br /> subsurface Nor should it be used for reaching a conclusion as to whether or not <br /> groundwater affected by hydrocarbons that may have been released into the subsurface on <br /> the 152 E 11th Street site has, or has not, coalesced with fuel components released into the <br /> subsurface on the Beacon Station site <br /> COOPERATIVE PROGRAM WITH ULTRAMAR INC. <br /> At the request of the SJCPHS, the Navarras and Ultramar Inc have agree to cooperate for <br /> the purposes of implementing a sampling plan for the unified array of monitoring wells on, <br /> and in the areas umnediately surrounding, their respective properties The purpose of the <br /> cooperation is solely to effect an efficient sampling program and permit the results of the <br /> samples to be available to the two parties and to the SJCPHS in an integrated and readily <br /> analyzable format <br /> As long as the agreement is in effect, the understanding between the parties provides for <br /> The San Joaquin Company Inc , as consultants to the Navarras, to have access to <br /> Ultramar's property at 153 East 11th Street and to Ultramar's monitoring wells for the <br /> purpose of taking samples according to the plan presented herein The San Joaquin <br /> Company will give notice to Ultramar prior to each occasion that access to their wells is <br /> required so that Ultramar may arrange to have a representative present when the work is <br /> performed The Navarras have agreed to provide Ultramar with the results of the <br /> groundwater depth measurements and the results of the analyses of samples recovered <br /> from the wells on both properties Ultramar and the Navarras have agreed to share the <br /> costs of implementing the plan <br /> The agreement between the Navarras and Ultramar to cooperate in the manner described is <br /> limited strictly to the objectives stated It is not intended to impose or unply any restriction <br /> or obligation on either party with respect to any use of the data obtained or to relieve either <br /> party of any reporting or other regulatory compliance requirements that may apply to either <br /> property Nothing in the cooperative agreement restricts the separate and independent <br /> action of either party with respect to its own property nor is it intended to limit in any way <br /> either party's legal rights or obligations Either party may terminate the agreement at any <br /> time and without notice to the other If, at any time or for any reason, either the Navarras <br /> or Ultramar elect to discontinue the cooperative sampling program, the Navarra's propose <br /> to continue with the planned schedule of groundwater samphng in so far as it involves their <br /> own monitoring wells unless the SJCPHS, or other regulatory agency having jurisdiction, <br /> requests otherwise <br />
