Generators conducting treatment under PBR must comply with hazardous waste generator standards. Many of the general require- <br /> ments that apply to generators may be found in 22 CCR in Chapter 12, beginning with §66262.10. These requirements include: <br /> General <br /> • determining whether or not a waste is hazardous (§66262.11), <br /> • obtaining an identification number(§66262.12), <br /> • keeping records of items such as manifests, reports, tests& analyses (§66262.40), <br /> • submitting reports such as the biennial report&exception reports (§66262.41 through§66262.43), <br /> • obtaining necessary permits or authorization and complying with applicable requirements for treatment,storage and disposal activities <br /> (§66262.10), <br /> • complying with requirements for waste pesticides and pesticide containers generated by farmers(§66262.70), and <br /> • complying with land disposal restrictions-by ensuring that all waste that is land disposed meet applicable treatment standards(Chapter <br /> 18). <br /> Accumulation <br /> When a generator accumulates and stores hazardous waste at the site of generation, and subsequently ships the waste off-site for <br /> recycling, treatment or disposal, certain requirements apply. These requirements include: <br /> • complying with accumulation times and procedures (§66262.34) <br /> • using appropriate containers and storing them properly(§66265.170 through§66265.177) <br /> • complying with applicable requirements for tank systems (§66265.190 through §66265.199, except §66265.197(c)) <br /> • using only a registered hazardous waste transporter(§66263.10) <br /> • using a manifest for hazardous waste shipments(§66262.20 through§66262.23) <br /> • properly packaging, labeling, marking and placarding hazardous waste shipments (§66262.30 through§66262.33) <br /> • complying with special requirements for international shipments (§66262.50 through §66262._60) <br /> • completing a land disposal restrictions notification statement(§66268.7): <br /> Planning <br /> Generators that accumulate hazardous wastes must also comply with requirements that both prevent foreseeable accidents and assist in <br /> preparation for emergencies. These requirements include: <br /> • properly designing and operating the facility(§66265.30 through §66265.37), <br /> • administering an employee training program (§66262.34(a)(4) and §66265.16), <br /> • preparing a contingency plan outlining procedures for emergencies(§66265.50 through§66265.56). Portions of the hazardous material <br /> business plan may serve to fulfill the requirements of the contingency plan (and/or vice versa). The business plan is required by the <br /> California Health and Safety Code, Division 20, Chapter 6.95. <br /> Source reduction plans and reports are required by the California Health and Safety Code(HSC),beginning with§25244.12 for compa- <br /> nies generating greater than 12,000 kg of hazardous waste per year. <br /> Generator Fees <br /> Payment of applicable fees,which depend upon: <br /> • the amount of waste generated, <br /> • the size of the generator and <br /> • the type of activities undertaken,which may include, but are not limited to, disposal fees(HSC§25174.1 to§25174.6), generator fees <br /> (HSC§25205.5),waste reporting surcharge (HSC§25205.9), environmental fees (HSC§25205.6), and manifest fee (HSC§25160.5). <br /> RECORDKEEPING: <br /> In addition to any recordkeeping requirements contained in the generator standards discussed above,as an onsite treatment facility,you <br /> must prepare and maintain the following records: <br /> • Written operating instructions for each treatment unit operated under PBR. _ <br /> • Records of the dates, amounts, and types of waste treated in each unit operated under the PBR_ 'These records must <br /> be adequate to demonstrate to an inspector that you have notified DTSC under the correct tier 1. <br /> • Annual waste analysis plan ~. <br /> • A written closure plan and annual update of closure cost estimate and financial mechanism <br /> • Written inspection schedule and a log of the inspections you conduct of each treatment unit. <br /> • Records to demonstrate compliance with all applicable pretreatment standards and industrial waste discharge requirements issued by <br /> the Publicly Owned Treatment Works (POTW). <br />
