1 3. Defendant, only in so far as it is doing business in the County of San Joaquin, in the <br /> 2 course of Defendant's INDUSTRIAL LAUNDRY activities, are pursuant to Health and Safety Code <br /> 3 section 25515.6 hereby enjoined for a period of five years from: <br /> 4 a. Failing to document training electronically or by hard copy and retain for a <br /> 5 minimum of three (3)years, in violation of Health and Safety Code section 25505(a)(4); and <br /> 6 b. Failing to submit an accurate hazardous materials inventory for all reportable <br /> 7 materials on site,in violation of Health and Safety Code section 25506(a). <br /> 8 4. Defendant shall pay to Plaintiff the sum of FIVE THOUSAND DOLLARS ($5,000.00), as <br /> 9 and for civil penalties,pursuant to Health and Safety Code § 25515.5, within five days after entry of <br /> 10 this Final Judgment by the Court. Said payments shall be delivered to the San Joaquin County Office <br /> 11 of the District Attorney, Environmental Crimes Unit, as per the following: <br /> 12 $2,500.00,made payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL <br /> 13 HEALTH DEPARTMENT—ENVIRONMENTAL HEALTH DIVISION TRUST; and <br /> 14 $2,500.00,made pa Tle to the SAN JOAQUIN COUNTY OFFICE OF THE <br /> 15 DISTRICT ATTORNEY. <br /> 16 5. Defendant shall fund Environmental Training Programs in the amount of THREE <br /> 17 THOUSAND DOLLARS ($3,000.00), as special projects, commonly known as Supplemental <br /> 18 Environmental Projects, as described below. The payment shall be due and payable to the below <br /> 19 mentioned agencies, and shall be delivered to the San Joaquin County Office of the District Attorney, <br /> 20 Environmental Crimes Unit, within five days after entry of this Final Judgment by the Court. The <br /> 21 THREE THOUSAND DOLLARS ($3,000.00)will be allocated as follows: <br /> 22 a. THREE THOUSAND DOLLARS ($3,000.00),made payable to the San Joaquin <br /> 23 County Environmental Health Department—Environmental Health Division Trust to be used by the <br /> 24 San Joaquin County Environmental Health Department, at its discretion,to fund compliance training <br /> 25 for local businesses. <br /> 26 6. Defendant shall additionally pay to Plaintiff the sum of TWO THOUSAND TWO <br /> 27 HUNDRED FOUR DOLLARS ($2,204.00) as partial recovery of the cost of investigation and suit <br /> 28 incurred by the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT.
