Defendant shall additionally pay to Plaintiff the sum of ONE THOUSAND FIVE <br /> 5 HUNDRED DOLLARS ($1,500.00) as partial recovery of the cost of investigation and suit incurred <br /> 6 by the SAN JOAQUIN COUNTY OFFICE OF THE DISTRICT ATTORNEY. Said payment shall <br /> 7 be due and payable to the aforementioned agency, and shall be delivered to the San Joaquin County <br /> 8 Office of the District Attorney,Environmental Crimes Unit,within five days after entry of this Final <br /> 9 Judgment by the Court. <br /> 10 8. Defendant shall pay to Plaintiff the sum of FOUR HUNDRED THIRTY-FIVE DOLLARS <br /> 11 ($435.00),for the uniform fee for filing the first paper in a civil action or proceeding in the Superior <br /> 12 Court. Said payment shall be made payable to the SAN JOAQUIN COUNTY SUPERIOR COURT <br /> 13 and delivered to the San Joaquin County Office of the District Attorney, Environmental Crimes Unit, <br /> 14 within five days after entry of this Final Judgment by the Court. <br /> 15 9. Except as otherwise expressly provided herein, each Party and the Environmental <br /> 16 Health Department and District Attorney's Office shall each bear its own attorneys' fees and costs. <br /> 17 10. Judgment shall be entered for and in favor of the People against Defendant on the <br /> 18 First Cause of Action arising under Health and Safety Code Sections 25505(a)(4) and 25506(a) as set <br /> 19 forth in Paragraphs 8(b) and 8(c) only, and all other causes of action and claims shall be dismissed <br /> 20 with prejudice, along with the Does in the People's Complaint. <br /> 21 11. This final judgment is a final and binding resolution and settlement of all violations <br /> 22 and causes of action arising from the facts set forth in the Complaint as to Defendant's facility <br /> 23 located at 819 N. Hunter Street, Stockton, California in San Joaquin County. The parties have <br /> 24 stipulated and consented to the entry of this final judgment before the taking of any proof and <br /> 25 without trial or adjudication of any factor law.
