1 within its custody or control containing personal information as required by Civil Code <br /> 2 1798 . 81 ; and <br /> 3 4 .4 .b.23 . Failing to comply with the California MWMA, Health and Safety Code <br /> 4 section 117600 et seq. , by failing to have a Medical Waste Management Plan, failing to <br /> 5 retain on file disposal receipts and tracking documents for waste shipped offsite for three <br /> 6 (3) years, and improperly storing, transporting, and disposing of pharmaceutical wastes . <br /> 7 4 .4 .c. Training Records - Defendant shall maintain proof of the training required by Title <br /> 8 22 of the California Code of Regulations, section 66265 . 34, subdivision (d) and Title 40 of the Code <br /> 9 of Federal Regulations, section 262 . 16, subdivision (b)(9) (iii) for each employee as follows : <br /> 10 4 . 4 . c. 1 . For any training conducted in accordance with 4 . 4 .b . , Defendants shall <br /> 11 maintain documentation sufficient to identify which employees received training and on <br /> 12 what dates . Such records may be maintained electronically. Defendants shall maintain any <br /> 13 documentation for a period of five (5) years from the date the training was conducted, in a <br /> 14 manner that allows retrieval of the records upon request by governmental inspection within <br /> 15 five (5) business days . <br /> 16 4 .4 .c .2 . Defendants shall require California employees providing hazardous waste- <br /> 17 related services to participate in a training program to familiarize them with hazardous <br /> 18 waste handling and emergency procedures, relevant to the employee ' s responsibilities <br /> 19 during normal operations and emergencies , within six (6) months of hire . California <br /> 20 employees shall not work in unsupervised positions providing hazardous waste-related <br /> 21 services until they have completed such training program . To facilitate compliance with <br /> 22 this requirement, Defendant shall review appropriate records quarterly; and . <br /> 23 4 .4 . c. 3 .
