Failing to establish, implement or submit to the responsible CUPA, a <br /> 4 hazardous materials business plan for each of the California Facilities, in violation of <br /> 5 Health and Safety Code sections 25505 , 25507, and 25508, and California Code of <br /> 6 Regulations, title 19, section 2650 ; <br /> 7 4 .4.b . 16. Failing to implement, maintain, and comply with an employee training <br /> 8 program on hazardous materials in violation of Health and Safety Code section <br /> 9 25505 (a) (4), and California Code of Regulations , title 19, section 2659; <br /> 10 4 .4 .b . 17 . Failing to immediately report any release or threatened release of a <br /> 11 reportable quantity of any hazardous material from any California Facility into the <br /> 12 environment, in violation of Health and Safety Code section 25510 ; <br /> 13 4 .4 .b . 18 . Failing to maintain adequate records demonstrating claim of exemption <br /> 14 for excluded recyclable material, as required by Health and Safety Code section 25143 .2 <br /> 15 and Title 22 of the California Code of Regulations , section 66261 . 2, subdivision (g) ; <br /> 16 4 .4 .b . 19 . Failing to maintain and operate facility to minimize the possibility of a <br /> 21 fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste, as <br /> 22 required by Title 22 of the California Code of Regulations, section 66265 . 31 ; <br /> 23 4 . 4 .b . 21 . Failing to test and maintain as necessary, all facility communications or <br /> 24 alarm systems, fire protection equipment, spill control equipment, and decontamination <br /> 25 equipment to ensure its proper operation in time of emergency, as required by Title 22 of <br /> 26 the California Code of Regulations, section 66265 . 33 , <br /> 27 4 .4 .b .22 .
