<br /> Marty Thorpe of Jim Thorpe Oil, Inc., informed Michael Kith that the ash sample results
<br /> revealed that that it was high in zinc and would be handled as hazardous waste. The large-sized
<br /> pieces of burned and unburned waste would be separated and hauled to Forward Landfill in
<br /> Manteca, CA, while the remainder, including ash, would be hauled as hazardous waste to
<br /> Kettleman Hills Hazardous Waste Facility in Kettleman City.

<br /> Marty Thorpe informed Michael Kith that the waste had been separated and the large-sized waste
<br /> was ready to be hauled to Forward Landfill. At the request of Marty Thorpe, the EHD issued an
<br /> exemption from waste hauling requirements to Jim Thorpe Oil, Inc.
<br /> May 29, 2009
<br /> Marty Thorpe informed Michael Kith that a total of five (5) loads of ash and related waste would
<br /> be hauled with a hazardous waste manifest to Cleanharbors Buttonwillow, LLC, by Dillard
<br /> Environmental Services, 3120 Camino Diablo, Byron, CA, (925) 634-6850. Four (4) loads had
<br /> already been hauled and completed, and the fifth load would be accomplished on June 1, 2009.

<br /> Marty Thorpe informed Michael Kith that he, Mr. Thorpe, had not yet received all the
<br /> documentation papers for the clean-up and requested that the re-inspection be postponed until
<br /> June 3, 2009.
<br /> June 3, 2009
<br /> One June, 3, 2009, Michael Kith, Robert McClellon and Alfonso Arambula, EHS, EHD,
<br /> conducted a re-inspection at Huffco Manufacturing and RCL Manufacturing. During the re-
<br /> inspection, the EHD observed about 200 waste tires inside the back building. There were 432
<br /> more waste tires stockpiled in the back lot, where the fire had previously occurred. The waste
<br /> tires were arranged in 12 rows of 30 each and 12 stacks of six (6) each. A yellow Penske Rental
<br /> Truck, License # 7T19767, was parked near the waste tires. Michael Kith asked Dale Huff,
<br /> Huffco CEO, where the waste tires came from. Dale Huff responded, "From Altamont."
<br /> Michael Kith asked Dale Huff, "How did you haul them?" Dale Huff responded, "In that truck
<br /> (pointing to the Penske Rental Truck). All my trucks were (lost) in the fire." When asked for
<br /> the name of the business where the tires originated from, Dale Huff responded, "I don't want you
<br /> to rat me out."
