Box 239 <br /> Tracy, CA 95378 <br /> NOTICE OF VIOLATION <br /> OF <br /> WASTE DISCHARGE REQUIREMENTS <br /> ORDER NO. 90-142 and ORDER NO. 96-118 <br /> AND <br /> ORDER FOR TECHNICAL REPORT <br /> TRIPLE E PRODUCE CORPORATION <br /> 8690 WEST LINNE ROAD, TRACY <br /> SAN JOAQUIN COUNTY <br /> Triple E Produce Corporation is hereby notified that failure to submit monitoring reports for the process <br /> wastewater treatment system as required since November 1994 is a violation of Waste Discharge <br /> Requirements Order No. 90-142. Triple E Produce Corporation is also notified that discharge of <br /> extracted groundwater to the aeration pond may have caused pollution to spread upgradient in violation <br /> of Order No. 96-118. <br /> Order No. 90-142 was adopted by the Board on 25 May 1990 and remains in full force and effect. Triple E <br /> Produce Corporation is in violation of Order No. 90-142 for failure to submit monitoring reports as <br /> required by Monitoring and Reporting Program (MRP)No. 90-142. Order No. 90-142 and MRP <br /> No. 90-142 require, in part: <br /> • Provision C.2: "The Discharger shall comply with the attached Monitoring and Reporting Program <br /> No. 90-142. " <br /> • MRP No. 90-142: "Monthly monitoring reports shall be submitted to the Regional Board by the <br /> 15th day of the following month, during the processing season. Quarterly monitoring reports shall <br /> be submitted to the Regional Board by the 15th day of the following quarter, during the offseason. " <br /> Our records show that the last submitted monitoring report under MRP No. 90-142 is for November <br /> 1994, which means that the Discharger is almost four years delinquent on this reporting. <br /> Groundwater beneath and north of the Triple E Produce facility is contaminated with trihalomethane <br /> constituents, of which chloroform is the primary contaminant, caused by past discharges of chlorinated <br /> tomato wash water to an infiltration pond. The contaminated groundwater plume extends approximately <br /> California Environmental Protection Agency <br /> C.1 Recycled Paper <br />
