The 4 November 2004 sample (140 µg/L), which exceeded the Daily Maximum Limitation, was resampled on 22 November 2004 (12 µg/L). o Only one soil sample was collected rather than two samples as required by the MRP. • Discharge Prohibition A.2 prohibits by-pass or overflow of untreated or partially treated waste. originating from the chlorinated wash water. By-pass has occurred at the site based on the concentrations of chloroform samples in the spray field. Finding No. 13 states chloroform concentrations would likely have concentrations from 2.5 to 11 µg/L; samples collected from the spray field had concentrations up to 1,300 µg/l, as described above. This indicates the treatment is incomplete or has been bypassed. During a 20 September 2005 inspection, you indicated the samples may have been incorrectly labeled and that the sample containing 1,300 µg/L was collected from wastewater prior to treatment. Facility Inspection A copy of the report from staff's 20 September 2005 inspection is enclosed for your information. As noted therein, no violations were noted at the time of the inspection. Required Improvements Triple E Produce is directed to immediately begin monitoring and reporting in accordance with the MRP. By 30 November 2005, please submit any of the missing data described above if it was collected. If the data is not available, please describe what measures will be implemented to ensure that all required monitoring is performed. Staff is in the process of revising the MRP to better reflect the site activities and be consistent with other food processing MRPs. A draft Revised MRP will be sent to you shortly.
