Box 239 <br /> Tracy, CA 95378 <br /> NO FURTHER ACTION REQUIRED, TRIPLE E PRODUCE, 8690 WEST-LINNE ROAD, <br /> TRACY, SAN JOAQUIN COUNTY <br /> Staff of the Central Valley Regional Water Quality Control Board have reviewed your 10 March 2004 <br /> Annual Report for 2003 (2003 Annual Report) and the 31 January 2005 Annual Report for 2004 <br /> (2004 Annual Report) submitted by Condor Earth Technologies, Inc. on behalf of Triple E Produce for the <br /> facility at 8690 West Linne Road in Tracy(site). Both Annual Reports discuss the fourth quarter sampling <br /> of monitoring well MW-7 as required by Monitoring and Reporting Program (MRP)No. R5-2003-0806, <br /> which was issued on 13 February 2003 based on Regional Board staff's 18 July 2002 No Further Remedial <br /> Action letter. As you know, the requirement to monitor MW-1 is contained in the Waste Discharge <br /> Requirements (WDRs) Order No. 99-123, which regulates the discharge of Triple E's process wastewater. <br /> Triple E Produce began monitoring trihalomethanes,primarily chloroform,pollution in groundwater at the <br /> site in 1990. The highest concentration of chloroform was detected in monitoring well MW-4A at a <br /> concentration of 1,900 micrograms per liter(ug/1) in April 1990. Prior to the destruction of MW-4A in <br /> March 2002,the concentration of chloroform was 17 ug/1. Triple E continued to monitor monitoring well <br /> MW-7 to verify a continuing decline in chloroform concentrations. Concentrations in MW-7 are stable at <br /> concentrations ranging between 8 and 10 ug/l. Therefore,based on the above information,no further action <br /> is required at this site. <br /> If Triple E and/or the Non-Chapter 15 Section of the Regional Board determine that MW-7 is not needed <br /> to monitor potential groundwater quality degradation resulting from wastewater application to land, <br /> Triple E Produce may proceed to arrange with San Joaquin County Environmental Health Department <br /> (SJCEHD) for the permitted destruction of the monitoring well MW-7. <br /> Nothing in this determination shall constitute or be construed as a satisfaction or release from liability for <br /> any conditions or claims arising as a result of past, current, or future operations at this location.
