y <br /> Page Three P90-43a <br /> Cost Proposal 23 April 1990 <br /> geotechnical assessment, estimated costs for the Scope of work <br /> outlined above would be $ 3,100.00 to $ 3,300.00. An additional <br /> $ 800.00 would be required if the geotechnical assessment is not <br /> included. Our fee for- the work and the terms under which our <br /> services are offered will be in accordance with the attached 1990 <br /> Schedule for Services. Any work order initiated as a result of <br /> this proposal will be subject to the scope of services, terms and <br /> conditions which are incorporated into this proposal. An invoice <br /> for this work will be submitted to you, as our client, at the <br /> completion of work. It is estimated 2-3 weeks will be required to <br /> complete the report after all required permits have been <br /> processed and approved. <br /> Indemnification <br /> As applied to this project, it is possible that the concept of <br /> joint and several liability could be construed to make the <br /> consultant partly or wholly responsible for damages created <br /> directly or indirectly by the presence of hazardous materials. <br /> The client agrees that it would be unfair for the consultant to <br /> be exposed to such an action, because the consultant had nothing <br /> whatsoever to do with the creation of any hazardous conditions. <br /> Accordingly, the client waives any claim against the consultant, <br /> and agrees to defend, indemnify and hold the consultant harmless <br /> from any claim, liability, damage, cost or expense, including but <br /> not limited to reasonable court costs, costs and attorneys, fees <br /> arising from application of a joint and several liability concept <br /> that would in any manner hold or seek to hold the consultant <br /> responsible for hazardous materials affecting the property. <br /> If you find the scope, conditions and costs of this proposal <br /> acceptable, please indicate your authorization to proceed by <br /> signing at the appropriate location on the attached Work Order <br /> and returning it to us.
