PUBI:IC HEALTH SERVICES oP
SAN JOAQUIN COUNTY Q .
JOGI KHANNA M.D.,M.P.H. S
Health Officer
o4 .Foaar
P.O. Box 2009 (1601 East Hazelton Avenue) •Stockton, California 95201 Ci
(209) 468-3400
CARL YEARING
C/O WILLIAM LOOK JR
200 CAMINO AGUAJITO STE 200
MONTEREY CA 93940
AUG 2 01993
RE: 521 NORTH CHEROKEE SITE CODE: 1324
LODI CA
This letter is being sent in response to your letter, dated August 12, 1993 to San Joaquin
County Public Health Services, Environmental Health Division (PHS/EHD) and to follow
up a telephone conversation on August 19, 1993, between you and PHS/EHD staff
regarding the above noted site.
The request in the letter to extend the date for the submittal of a workplan to investigate
the full extent of the soil and groundwater contaminant plumes for 30 days is granted.
The new date for the submittal of a workplan is October 4, 1993. Failure to meet this
deadline may result in formal enforcement action against all responsible parties.
Data collected to date shows that the damage to the environment at this site has been
significant. The groundwater, designated for domestic, municipal, agricultural and
industrial use by the State Water Resources Control Board, has been severely impacted.
For this reason, this site is considered to be a high priority site and progress in the
investigation and abatement of the soil and groundwater contamination must continue in
a timely manner. Ongoing litigation is not justification for delays in the investigation and
abatement of the contamination.
Please be advised that a directive from this office to proceed with corrective action is an
enforcement action and that sites are not removed from the program until corrective
action has been satisfied and the site is certified with closure. It is the responsibility of
each listed responsible parry to comply with the requirements of Section 25299.37,
Chapter 6.75 of the California Health and Safety Code. PHS/EHD is the regulatory
agency responsible for ensuring compliance with the laws and regulations governing
underground storage tanks. Responsible parties are encouraged to cooperate with each
other so that corrective action will progress and the site will remain in compliance with
A Dm m of San Joaquin County Health fare services C
