Your letter stated that your <br /> clients, Carl and Muriel Yearing, received a second notice of our UST Cleanup <br /> Site invoice dated May 8, 1991 but did not receive the original invoice. We <br /> have reviewed our files and determined that San Joaquin County notified the <br /> Yearings by letter dated August 3, 1990 that they were being identified as <br /> responsible parties for this site. However, the information was not entered <br /> into our computer system at the State Water Resources Control Board until <br /> after the May 8, 1991 invoices were mailed. We are sorry for any <br /> inconvenience this has caused and under separate cover we are sending the <br /> Yearings a copy of the original invoice. The Yearings may disregard the <br /> July 12, 1991 second notice as another second notice will be sent in 30 days, <br /> if the account is not paid. We have also enclosed a copy of the invoice for <br /> your information and hope that the following discussion will answer your <br /> concerns. <br /> We are sorry that your clients are in ill health, however we are required by <br /> law to send the invoices to all responsible parties named by San Joaquin <br /> County for this site. Your letter indicates that there is an agreement among <br /> the responsible parties as to who will be paying for the costs of cleanup. <br /> Any agreement among the various parties assigning responsibility for cleanup <br /> would be a civil matter separate from the identification of responsible <br /> parties under the Local Oversight Program. Under the Local Oversight Program, <br /> your clients, along with any other responsible parties, are jointly and <br /> severally liable for oversight costs. For your information, we have enclosed <br /> a list of responsible parties for this site. <br /> The following information is given to explain the costs in the invoice. The <br /> invoice contains several categories of costs. Site specific charges represent <br /> those charges for work done that is directly related to your client's site. <br /> Examples of such activities include: sampling for soil or groundwater <br /> contamination, conducting site inspections, reviewing reports and workplans, <br /> or preparing correspondence. Activities performed for your client's site are <br /> itemized on the bill . A description of activity codes is enclosed for your <br /> reference. <br />
