After reviewing the responses to the <br />Operation Plan deficiencies, the Department will then <br />determine whether the permit requires major modification or <br />a permit application resubmittal. Any subsequent future <br />revisions to the Operation Plan will also be subject to <br />major modification of the permit or permit application <br />resubmittal. <br />2. The owner or operator shall operate and maintain the <br />facility in accordance with the Operation Plan and the <br />provisions of this permit. <br />3. In the event of any conflict between this permit and the <br />Operation Plan referenced herein, the provisions of the <br />permit shall be controlling. <br />4. The Operation Plan shall be maintained at the facility and <br />place of business at all times until closure is completed. <br />G. General Responsibilities of Operator <br />1. Compliance <br />a. The owner or operator shall comply with all conditions <br />of this permit, except to the extent and for the <br />duration such noncompliance is authorized by an <br />emergency permit or approved by the Department. Any <br />permit noncompliance constitutes grounds for <br />enforcement action, permit termination, revocation and <br />reissuance, modification, or for denial of a permit <br />renewal application. <br />b. The owner or operator shall comply with all laws, <br />regulations, permits, zoning conditions, and all other <br />requirements established by federal, state, and local <br />agencies. <br />2. Reapplication <br />=f the owner or operator wishes to continue an activity <br />regulated by this permit after the expiration date of this <br />permit, the owner or operator must submit a completed <br />application for a new permit at least 180 days before this <br />permit expires. <br />3. Permit Expiration <br />Except as provided by Section 66377, CCR, this permit and <br />all conditions therein shall remain in effect beyond the <br />permit expiration or termination date if the owner or <br />operator has submitted a timely, completed application and, <br />through no fault of the owner or operator, the Department <br />has not issued a new permit. <br />-4- <br />
