•• <br />which impose requirements which are in addition to or more <br />stringent than those in existence at the time this permit <br />was issued. The owner or operator shall comply with any <br />such additional or more stringent requirements in addition <br />to the requirements and conditions specified in the permit. <br />3. The Department's issuance of this permit does not convey <br />property rights of any sort of any exclusive privilege, nor <br />does it authorize any injury to persons or property or any <br />invasion of other private rights. <br />4. The owner or operator is permitted to recycle used oil in <br />accordance with the conditions of this permit. The owner <br />or operator shall perform the hazardous waste management <br />activity authorized by this permit in accordance with the <br />plans and specifications approved by the Department. Any <br />management of hazardous waste not authorized in this permit <br />is prohibited. <br />C. Permit Actions <br />This permit may be modified, revoked and reissued, or terminated <br />for cause as specified in Sections 66382, 66383, and 66385, <br />Title 22, CCR. A new facility permit condition or a <br />modification of an existing facility permit condition shall <br />become effective on the date that written notice of such change <br />is received by the owner or operator. The filing of a request <br />for a permit modification, revocation and reissuance, or <br />termination or the modification of planned changes or <br />anticipated noncompliance on any part of the owner or operator <br />does not stay the applicability or enforceability of any permit <br />condition. <br />D. Need to Halt or Reduce Activity <br />It shall not be a defense for the owner or operator in an <br />enforcement action that it would have been necessary to halt or <br />reduce the permitted activity in order to maintain compliance <br />with the conditions of this permit. <br />E. Severability <br />The provisions of this permit are severable, and if any <br />provision of this permit or the application of any provision of <br />this permit to any circumstance is held invalid, the application <br />of such provision to other circumstances and the remainder of <br />this permit shall not be affected thereby. <br />F. Operation Plan <br />1. By the issuance of this permit, the Operation Plan dated <br />November 11, 1988 is hereby approved. Section IV.B <br />describes deficiencies found in the Operation Plan. The <br />responses to those deficiencies noted in Section IV shall <br />be submitted to the Department within 60 days from the date <br />-3- <br />
