Wallace, Sr. Trust `j ^ 2005 <br /> 7455 Pasaro Drive East <br /> Scottsdale, AZ 85262 ENVIRONMENT HEALTH <br /> RMI <br /> Dear Mr. Wallace: <br /> UNDERGROUND STORAGE TANK (UST) CLEANUP FUND (FUND), REVISED FINAL <br /> DIVISION DECISION(FDD), CLAIM NO. 1714, FOR SITE ADDRESS: 348 WEST HARDING <br /> WAY, STOCKTON, CALIFORNIA <br /> This revised FDD concerns past costs that have been reimbursed by the Fund, but have since been <br /> determined ineligible for reimbursement. The total amount that the Fund has reimbursed to date is <br /> $134,913.19. Costs associated with corrective action to investigate and remediate chlorinated solvent <br /> contamination are not eligible for reimbursement from the Fund. In an FDD, dated July 19, 2004, I <br /> determined that the Fund has overpaid a total of$37,576.47 for costs attributable to chlorinated <br /> solvents. The State Water Resources Control Board(State Water Board)received a petition from you <br /> on August 17, 2004,requesting review of the FDD. <br /> An error in the calculation of the overpayment was discovered while reviewing the contentions in your <br /> petition. As a result, I am issuing this revised FDD to correct the error in the calculation of the <br /> overpayment. Consequently, this revised FDD supersedes in part the prior FDD with respect to the <br /> total amount of the overpayment by the Fund. The correct amount of the overpayment is $42,043.34. <br /> The prior FDD remains in effect regarding my determination that it is appropriate to evenly split <br /> investigation costs incurred after December 6, 1996,between the Stoddard solvent and chlorinated <br /> solvents. Additionally, the prior FDD is still in effect regarding the conclusion that it is appropriate to <br /> continue to evenly split investigation costs between the Stoddard solvent and chlorinated solvents in the <br /> future, unless, and until, it is shown that the extent of the chlorinated solvents plume goes well beyond <br /> the Stoddard solvent plume. <br /> Background <br /> Site History and Relevant Correspondence <br /> The Peter J. Wallace, Sr. Trust (claimant) owns the property at 348 West Harding Way, Stockton, <br /> California. The property was previously used as a commercial dry cleaning operation. According to <br /> the claim application, all of the USTs at the site previously contained total petroleum hydrocarbons as <br /> Stoddard solvent(Stoddard solvent) and the USTs were removed in 1991. The tanks had not been used <br /> for a considerable time prior to their removal.
