- 2 - <br /> D. In the C&A, the Problem Assessment Report (PAR) due date was 25 May 1990 <br /> and the final remedial plan (FRP) due date was 29 June 1990. However, <br /> submittal of the PAR was extended to 28 June 1991 to allow Geweke to <br /> come into compliance. No new submittal date was set for the FRP. The <br /> PAR was submitted but the plume remains undefined to the west of MW-11 . <br /> Therefore, Geweke is to install an additional monitoring well down <br /> gradient of MW-11 and subsequently, submit an FRP, including the results <br /> of the installation of the new well , by 2 December 1991. Should Geweke <br /> fail to comply with the 2 December 1991 FRP due date, any consideration <br /> of fines will be based on the original FRP due date, 29 June 1990. <br /> E. Cleanup and Abatement Order No. 90-702 (C&A) orders the following: <br /> 113. Monitor the depth to ground water obtain water quality samples, <br /> and analyze the samples for total petroleum hydrocarbons, benzene, <br /> toluene and xylenes in all existing and future monitoring wells on <br /> a quarterly basis. Submit quarterly ground water monitoring <br /> reports until such time as the Executive Officer determines that <br /> the reports are no longer necessary. " <br /> We recommend that you issue Geweke a Notice of Violation due to Geweke's <br /> failure to submit quarterly reports that were due 15 April and 15 July <br /> 1991 . In a letter to you from Jim Maughan, of this office, dated 20 May <br /> 1991, he noted that Geweke had not submitted the April quarterly report <br /> and stated that it should be submitted immediately. <br /> The next quarterly report is due 15 October 1991. Failure to submit <br /> quarterly reports as scheduled is a violation of the C&A and Geweke may <br /> be subject to fines under Section 13350 of the California Water Code. <br /> Failure to submit quarterly reports is also a violation of Section <br /> 2652(d) of the Underground Tank Regulations and subject to additional <br /> fines. <br /> If you have any questions, please call me at (916) 361-5726. <br /> ELIZABAssoci H A.
