}
CHRONOLOGY
C&A NO. 90-702
GEWEKE LAND DEVELOPMENT & MARKETING
16 SOUTH CHEROKEE LANE, LODI
SAN JOAQUIN COUNTY
In 1985, one monitoring well was installed and ground water contamination was
detected and by 1986, a total of 5 wells had been installed but additional
investigation was necessary to define the contamination. By 1989, no additional
wells had been installed and reports were incomplete.
5 Mar 90 C&A No. 90-702 was issued. The C&A required submittal of
quarterly reports, a work plan to define the contamination by
23 March 1990, implementation of the work plan by 13 April
1990, submittal of a PAR by 25 May 1990, submittal of an FRP
by 29 June 1990, and implementation of the FRP by 24 August
1990.
20 Mar 90 In a letter to the Executive Officer, Geweke' s attorney stated
• that Geweke was disappointed in the C&A because they purchased
the property without knowledge of the contamination, they did
not believe there was substantial contamination at the site or
that the soil contamination at the site caused the ground
water contamination.
23 Mar 90 The work plan, proposing 4 new wells, was submitted by Brown
& Caldwell (B&C) , Geweke's consultant.
2 Apr 90 In a letter to Office of Chief Counsel , Geweke' s attorney
filed a petition to rescind the C&A.
2 Apr 90 In a letter to the Executive Officer, Geweke' s attorney
notified the Board of the appeal to rescind the C&A.
4 Apr 90 In a letter to Geweke, the Executive Officer accepted the work
plan and repeated the C&A due dates for. the PAR and FRP.
15 Apr 90 Work plan was to be implemented this date. It was not.
25 May 90 Geweke's consultant, BC submitted a letter stating that the 5
existing monitoring wells had been sampled.
25 May 90 The PAR was not submitted as required by the C&A.
30 May 90 In a letter to State Board staff, Geweke's consultant
requested that a hearing for rescinding the C&A be held in
abeyance.
