Cherokee Service Center A91701.01 <br /> July 10, 1996 Page 3 <br /> Task 3 - Supplemental Report <br /> Following completion of the field and laboratory investigations, Twining will prepare a <br /> Supplemental Site Characterization Assessment Report with the data collected during this work <br /> consistent with the SJCPHS-EHD's requirements for report submittals. The report will <br /> summarize field and analytical data. In addition, the report will include Twining's conclusions <br /> and recommendations. The report will be signed by a registered professional. <br /> SITE SAFETY <br /> It is anticipated that Twining personnel will conduct the proposed work in Level D personal <br /> protective gear. Field activities will be conducted based on the site safety plan presented in <br /> Appendix B of the Amended Work Plan. <br /> UUMrATIONS <br /> The purpose of a geologic/hydrogeologic study is to reasonably characterize existing site <br /> conditions based on the geology/hydrogeology of the area. In performing such a study, it is <br /> understood that a balance must be struck between a reasonable inquiry into the site conditions <br /> and an exhaustive analysis of each conceivable environmental characteristic. <br /> No investigation is thorough enough to describe all geologic/hydrogeologic conditions of interest <br /> at a given site. If conditions are not identified during the study, such a finding should not be <br /> construed as a guarantee of the absence of such conditions at the site, but rather as the result of <br /> the services performed within the scope, limitations, and cost of the work performed. <br /> There are no third-party beneficiaries of this agreement between the client and Twining and no <br /> third-party shall be entitled to rely upon any work performed or report prepared by Twining <br /> hereunder for any purpose whatsoever. The client shall indemnify and hold Twining harmless <br /> against any liability to any third-party for any loss, expense, or damage arising in connection <br /> with reliance by any such third-party on any work performed or reports issued by Twining. <br /> Twining's professional services will be performed, findings obtained, and conclusions prepared <br /> consistent with generally-accepted environmental assessment principles and practices in San <br /> Joaquin County at the time the work is performed. This warranty is in lieu of all other <br /> warranties, either express or implied. <br />
