INSURANCE <br /> Central Valley Kitchens & Toby Chandler shall be listed as additional insured loss payee. <br /> Lessor maintains blanket liability insurance coverage for the common areas of the building. <br /> Lessor's insurance does not cover Lessee's property in the building and on the premises. <br /> Lessor shall not be liable to Lessee, or to any other person, for any darnages on account of <br /> loss, damage, fire or theft of any personal or business property. <br /> Liability insurance: <br /> Caterers and vendors shall maintain liability insurance in accordance with the requirements <br /> of the State of California and/or Land Owner/Lessor. <br /> Lessee shall obtain and keep in force during the term of this lease a commercial general <br /> liability policy of insurance protecting Lessee. Lessor and any Lender(s) whose names have <br /> been provided to Lessee in writing as additional insured against claims for bodily injury, <br /> personal injury and property damage based upon, involving or arising out of the ownership; <br /> use, occupancy or maintenance of the premises and all areas appurtenant thereto. <br /> Such insurance shall be on an occurrence basis providing single limit coverage in an <br /> amount not less than $1,000,000.00 per occurrence with an `Additional Insured-Managers or <br /> Lessor's of Premises" endorsement and contain an amendment of the Pollution Exclusion <br /> endorsement for damage caused by heat, smoke or fumes from a hostile fire. The policy shall <br /> not contain any intra-insured exclusions as between insured persons or organizations, but <br /> shall include coverage for liability assumed under this lease as an insured contract for the <br /> performance of Lessee's indemnity obligations under this lease. <br /> The limits of said insurance required by this lease or as carried by Lessee shall not, <br /> however, limit the liability of Lessee nor relieve Lessor of any obligation hereunder. All <br /> insurance required by this lease or as carried by Lessee shall not, however, limit the liability of <br /> Lessee nor relieve Lessor of any obligation hereunder. All insurance carried by Lessee shall <br /> be primary to and not contributory to any similar insurance carried by Lessor; whose insurance <br /> shall be considered excess insurance only. <br /> INDEMNITY <br /> Caterers and Venders/Lessees and their assistants and agents assume all risk of personal <br /> injury or property damage not arising out of the willful misconduct of Toby Chandler, and agree <br /> to indemnify and hold harmless the Lessor for any and all clairns, costs or expenses incurred <br /> as a result of the conduct of Vendors and/or their assistants. <br /> Lessee shall indemnify and hold harmless Lessor from and against any and all claims arising <br /> from Lessee's use of the premises, or from the conduct of the Lessee's business or from any <br /> activity, work or things done, permitted or suffered by Lessee on the premises and shall further <br /> indemnify and hold harmless Lessor from and against any and all claims arising from any <br /> negligence of the Lessee, or any of Lessee's agents, contractors, visitors, or employees, and <br /> frorn and against all costs, attorney's fees, expenses and liabilities incurred in the defense of <br /> any such claim or any action or proceeding brought thereon, and in case any action or <br /> proceeding be brought against Lessor by reason of any such claim. Lessee, as a material pant <br /> of the consideration to Lessor, hereby assumes all risk of damage to property to injury to <br /> persons on the premises and Lessee hereby waives all claims in respect thereof against <br /> Lessor as it pertains to Lessee's operations. <br /> Additionally, Lessee shall not use the kitchen, or any portion of the Lessor's premises for the <br /> purpose of any illegal act, nor allow the performance of any such act by the Lessee's <br /> customers or guest. <br /> ,U <br /> I�, <br />
