UTILITIES: <br /> the Lessor pays for utilities and maintenance of exhaust system, make up air & grease trap. <br /> Lessor is not liable to Lessee by reason of any failure to provide, or the inadequacy of utilities <br /> or janitorial. Lessor is not responsible for any negligence of the building's agents, servants or <br /> employees. Lessee may not deduct or offset any amount from rent due herein because of any <br /> problem regarding utilities, janitorial services, maintenance services or defective construction <br /> of premises. Lessor is responsible for Maintenance on only major equipment in kitchen, <br /> including: Freezer, Refrigerator, Six burner stove with oven, 20 quart mixer, Confection oven, <br /> all sinks, Parking lot with 2 parking spaces belonging to the kitchen. <br /> COMMON AREA <br /> All areas not designated for exclusive use of tenants or available for lease of prospective <br /> tenants constitute the building's common areas. Lessee shall have the non-exclusive right of <br /> access and use of the common areas and facilities contained therein. <br /> ADVERTISING <br /> Lessee is responsible for his/her own advertising. The owner of the building and the <br /> Lessor must first approve in writing any signs put on the building. <br /> FINES <br /> Lessee is responsible to pay in full all fines and penalties incurred by Lessee; regardless of <br /> prior offenses, due for violations cited by the County Health Department or any other entity, for <br /> failure to comply with any Law or Regulation. <br /> BUSINESS POLICY <br /> Lessee shall at all tirnes maintain a general policy of satisfaction of their customers and <br /> shall promptly and properly adjust at Lessee's own expense; all complaints of and <br /> controversies with customers and the State of California, Dept. of Consumer Affairs and the <br /> Health Department. <br /> REIMBURSEMENT FEES <br /> Lessee shall reimburse Lessor for any and all reasonable legal and/or other expenses <br /> incurred in the endeavor of collecting monies due Lessor from Lessee. <br /> ATTORNEY FEES & CONTROLLING LAW <br /> Should a breach of this agreement occur, the prevailing party shall be entitled to attorney's <br /> fees and costs of lawsuit?
