Box 8068 <br /> Stockton, CA 95208 <br /> DELTA TRUCK SALES, STOCKTON, SAN JOAQUIN COUNTY, NOTICE OF <br /> VIOLATION <br /> Delta Truck Sales was notified by letter dated 16 September 1987 <br /> of its responsibility to cease discharge of hazardous waste to a <br /> surface impoundment by 30 June 1988 . Delta Truck Sales submitted <br /> a workplan to the Regional Board dated 26 April 1988 which <br /> provided for the removal of all wastes from the surface <br /> impoundment. The workplan submitted by Delta Truck Sales stated, <br /> "This work would, at a minimum, constitute an initial phase of a <br /> HAR as delineated in section 25208.7 (b) of the TPCA, and should <br /> fulfill the requirement to cease discharge by 30 June 1988. " <br /> Although the workplan was approved by the Board' s staff on 19 May <br /> 1988, it has not yet been implemented. Delta Truck Sales is now <br /> in violation of Section 25208 . 4 of the Health and Safety Code <br /> which states, " . . . , a person shall not discharge liquid hazardous <br /> wastes or hazardous wastes containing free liquids into a surface <br /> impoundment after June 30, 1988, . . . " <br /> On 26 January 1988, Delta Truck Sales was notified that they had <br /> failed to meet the statutory deadline for submittal of a <br /> Hydrogeological Assessment Report (HAR) . Section 25208 .9 (a) of <br /> the Health and Safety Code states " . . . , any person who is <br /> required to file a hydrogeological assessment report with a <br /> regional beard pursuant to Section 25208 . 7, and who fails to do <br /> so, shall be liable civilly in a sum of not less than one <br /> thousand dollars ($1, 000) and not more than ten thousand dollars <br /> ($10, 000) for each day the report has not been received. " <br /> Correction of these violations of the Toxic Pits Cleanup Act will <br /> require that you complete the following tasks as soon as <br /> possible: <br /> 1. Remove all hazardous wastes from your surface impoundment. <br /> 2 . Close the surface impoundment. <br /> 3 . Submit the Hydrogeological Assessment Report. <br />
