Delta Truck Sales -2- 3 January 1989 <br /> As an initial step toward compliance, we require that you submit <br /> a technical report to this office no later than 15 March 1989 <br /> which contains the following: <br /> a. Results of the hazardous waste removal and site <br /> investigation as described in the workplan you submitted <br /> which was dated 26 April 1988 . <br /> b. Recommendations for further investigation leading to the <br /> completion of a HAR. <br /> C. A timetable for implementation of those recommendations. <br /> Our authority to require this technical report is Section 13267 <br /> of the Water Code. Pursuant to Section 13268 of the California <br /> Water Code, a civil liability may be imposed for failure to <br /> submit this technical report in an amount not to exceed $5, 000 <br /> for each day in which the violation occurs. <br /> Delta Truck Sales will continue to be liable for annual fees <br /> until the regulated surface impoundment has ceased discharge of <br /> hazardous wastes. The actual costs of staff time and other <br /> associated program costs will continue to be billed quarterly <br /> until the HAR is submitted, and staff's review is complete. <br /> We strongly urge you to begin taking action to bring your <br /> facility into compliance and to submit the technical report <br /> required by this notice. otherwise, we will have to consider <br /> recommending to the Regional Board formal enforcement action and <br /> referral of your case to the Attorney General. <br /> Members of my staff are available to meet with you at your <br /> convenience.
