Cherokee /SERVICES
Stockton, CA 95205
TOXIC PITS, CLEANUP ACT (TPCA) , REQUEST FOR IMPOUNDMENT CHARACTERIZATION
Enclosed for your information is a copy of a report regarding a Regional Board
inspection of your facility. The report indicates that you are probably subject
to the TPCA (Article 9.5 of Chapter 6.5 of Division 20 of the Health and Safety
Code) , since your surface impoundment containing waste oils was closed after 1
January 1985, the effective date of the regulations ( a copy of the law is
enclosed) .
Since the surface impoundment has been filled in, we could not verify its size and
construction, or evaluate how it was operated. We must therefore request that a
site characterization be completed to determine if any waste oils remain in the
surface impoundment area. If any oils are found, then samples must be taken to
determine if any hazardous constituents are present. Enclosed is some information
on how to prepare a sampling and analysis plan for your surface impoundment.
.Provisions of the TPCA include requirements to complete a' hydrogeologic assessment
report (HAR) and the submission of fees to support the State and Regional Boards
when carrying out their responsibilities under the TPCA. Such responsibilities
include reviewing HARs and conducting inspections.
Please provide us by 15 January 1987 your consultant' s plan and schedule to
characterize the surface impoundment area. Board staff may want to be present
during excavation/sampling to enable split samples to be taken.
If you have any questions regarding our requests or the TPCA regulations, please
call me at (916) 322-1599.
PATRICIA H.
