Cherokee /SERVICES <br /> Stockton, CA 95205 <br /> TOXIC PITS, CLEANUP ACT (TPCA) , REQUEST FOR IMPOUNDMENT CHARACTERIZATION <br /> Enclosed for your information is a copy of a report regarding a Regional Board <br /> inspection of your facility. The report indicates that you are probably subject <br /> to the TPCA (Article 9.5 of Chapter 6.5 of Division 20 of the Health and Safety <br /> Code) , since your surface impoundment containing waste oils was closed after 1 <br /> January 1985, the effective date of the regulations ( a copy of the law is <br /> enclosed) . <br /> Since the surface impoundment has been filled in, we could not verify its size and <br /> construction, or evaluate how it was operated. We must therefore request that a <br /> site characterization be completed to determine if any waste oils remain in the <br /> surface impoundment area. If any oils are found, then samples must be taken to <br /> determine if any hazardous constituents are present. Enclosed is some information <br /> on how to prepare a sampling and analysis plan for your surface impoundment. <br /> .Provisions of the TPCA include requirements to complete a' hydrogeologic assessment <br /> report (HAR) and the submission of fees to support the State and Regional Boards <br /> when carrying out their responsibilities under the TPCA. Such responsibilities <br /> include reviewing HARs and conducting inspections. <br /> Please provide us by 15 January 1987 your consultant' s plan and schedule to <br /> characterize the surface impoundment area. Board staff may want to be present <br /> during excavation/sampling to enable split samples to be taken. <br /> If you have any questions regarding our requests or the TPCA regulations, please <br /> call me at (916) 322-1599. <br /> PATRICIA H.
