P. <br /> Services regarding results from sampling the abandoned waste oil <br /> surface impoundment at Delta Truck Sales. Attachment 1 is a <br /> memorandum with comments on the waste characterization. Based on <br /> the data we have determined that your facility is regulated by <br /> the Toxic Pits Cleanup Act (TPCA) (Article 9 . 5, Chapter 6 . 5, <br /> Division 20 of the Health and Safety Code) . This letter is to <br /> inform you of the regulations contained in the TPCA, and your <br /> obligations incurred under the act. For your information I have <br /> enclosed a copy of the TPCA with an explanation of the <br /> requirements (Attachments 2 and 3) , and some definitions <br /> (Attachment 4) . <br /> The TPCA requires that all owners/operators of regulated <br /> impoundments submit a Hydrogeological Assessment Report (HAR) . <br /> The HAR outline (Attachment 5) is intended to provide guidance <br /> and assist Delta Truck Sales in the development of the HAR for <br /> this site. <br /> A HAR SHALL BE SUBMITTED TO THIS OFFICE, PURSUANT TO SECTION <br /> 13267 (b) OF THE CALIFORNIA WATER CODE AND SECTION 25208 . 7 OF T:=E <br /> TPCA, BY 1 JANUARY 1988, ALONG WITH PLANS AND A TIME SCHEDULE O <br /> CEASE DISCHARGING BY 30 JUNE 1988 (Cease Discharge is defined in <br /> Attachment 4) . A PROPOSED WORK PLAN (TECHNICAL REPORT) DEVELOPED <br /> TO MEET THE HAR REQUIREMENTS SHALL BE SUBMITTED, PURSUANT TO <br /> SECTION 13267 (b) OF THE CALIFORNIA WATER CODE, BY 15 OCTOBER <br /> 1987. A REVIEW OF THE WORK PLAN AND A MEETING BETWEEN YOUR <br /> CONSULTANT AND REGIONAL BOARD STAFF WILL PROVIDE NECESSARY INPUT <br /> AND GUIDANCE TO MEET THE TPCA REGULATIONS. <br /> As explained in Attachment 3 , fees are required to be paid by the <br /> owner/operator to cover the costs incurred by the State Water <br /> Resources Control Board (State Board) and Regional Board in <br /> administering the law.The 1987-88 annual fees of $3000 for the <br /> surface impoundment at your facility have been paid, but the <br /> initial fee of $1500 is still due. Instructions for payment of <br /> the fee is provided on the enclosed form entitled "Hazardous <br /> Waste Surface Impoundment Fee Transmittal" (Attachment 6) . These <br />
