Under the TPCA, you must cease discharge to <br /> this surface impoundment by 1 July 1988 and close the impoundment <br /> in accordance with a schedule to be approved by the Regional <br /> Board. Attachment 1 describes the difference between closure and <br /> "cease discharge" . <br /> Closure of your surface impoundment is regulated by the <br /> California Administrative Code (CAC) , Title 22 , Chapter 30, <br /> Division 4 , commencing with Section 67210; and by CAC, Title 23 , <br /> Chapter 3 , Subchapter 15, commencing with Section 2580. Before <br /> you begin closure, we require that you submit to us a closure <br /> plan for approval which complies with these regulations and which <br /> includes a time schedule to complete closure activities. If you <br /> cannot "clean close" your impoundment (that is, remove all <br /> residual waste and contamination) then we require that you submit <br /> to our office not only a plan for post-closure activities, but <br /> also, pursuant to Section 13260 of the Water Code, a Report of <br /> Waste Discharge. Enclosed are guidelines for the preparation of <br /> your closure plan (Attachment 2) and post-closure plan <br /> (Attachment 3) and a Report of Waste Discharge form (Attachment <br /> 4) . <br /> Both the Regional Board and the Department of Health Services <br /> regulate the closure of surface impoundments. In order to avoid <br /> duplicate or redundant work, the Board and the Department agreed <br /> that the Board will act as the lead agency for site closures <br /> under TPCA. As lead, the Board will regulate your activities to <br /> close the impoundment as defined by the TPCA in Section <br /> 25208 . 2 (d) of the Health and Safety Code. The Board also will <br /> coordinate its comments on your closure plan with those of the <br /> Department, and will send out letters which include the comments <br /> or approval of both agencies. However, the Department, as well <br /> as the Board, reserve their independent authorities to take <br /> enforcement action where necessary. Furthermore, if your site is <br /> ranked on the State priority list for removal and remedial <br /> action, then the Department will retain its lead responsibilities <br /> for site mitigation.
