1. 4 . Jurisdiction. Section 25187 of the Health and Safety <br /> Code (HSC) authorizes the Department to order corrective action <br /> and assess a penalty when the Department determines that any <br /> person has violated specified provisions of the Health and Safety <br /> Code or any permit, rule, regulation, standard or requirement <br /> issued or adopted pursuant thereto. <br /> Y <br /> DETERMINATION OF VIOLATIONS <br /> 2 . The Department has determined: <br /> 2 . 1. The Respondent violated Title 22, California Code of <br /> Regulations (Cal. Code Regs. ) , Section 66262 . 34 (e) (1) . on or <br /> about November 16, 1993, the Respondent failed to manage a 55- <br /> gallon satellite accumulation container of sandblast metal grit <br /> containing hazardous metals (lead and chromium) , in Building 26, <br /> at or near the point of generation. <br /> 2 . 2 . The Respondent violated Title 22 , Cal. Code Regs. , <br /> Section 66264 . 175 (b) (1) . On or about November 16, 1993 , the <br /> Respondent failed to maintain an impervious base that can contain <br /> leaks, spills, and accumulated precipitation in the permitted <br /> container storage area. <br /> 2 .3 . The Respondent violated Title 22 , Cal. Code Regs. , <br /> Section 66262 . 34 (f) (3) . On or about November 16, 1993, the <br /> Respondent failed to appropriately label five containers in <br /> Warehouse 28 . Each container held absorbent waste individually <br /> contaminated with each of the following constituents: battery <br /> acid, antifreeze, diesel fuel, waste oils, and hydraulic fuels. <br /> 2 <br />
