Clean Water Act <br /> EPA has stated in comments dated June 7, 1993, (p. 30/40) that <br /> this statute should be deleted from the federal table. <br /> Corrective Action: Delete this section. <br /> e. Underground Injection Control Regulations <br /> EPA's position remains the same as articulated in its comments <br /> dated June 7, 1993 (p. 31/40) , i.e. , UICR is not an ARAB. <br /> Corrective Action: Delete this section. <br /> f. Endangered Species Act <br /> This ARAR should remain in the federal table. However, the <br /> comment section of the table may need to be revised. Is the <br /> Natural Resource Damage Assessment by the Cal Dept. of Fish and <br /> Came being conducted pursuant to the ESA? (Note: The ESA <br /> provides for a "biological assessment" that may be designated to a <br /> non-federal agency to perform. ) If not, then it is a separate <br /> issue from compliance with the ESA and should be either deleted <br /> from the comment section or clarified to explain under what <br /> EPA/R9 July 28, 1993 4/7 <br />
