authority the assessment is being undertaken. Please verify
whether 50 CFR Part 200 is the correct cite.
Corrective Action: Revise the comment and citation accordingly.
15. Table 10.2-2 State ARARs
a. Air Resources Act
EPA has requested that DTSC clearly identify which sections of the
Health and Safety Code and CCR Title 17 establish emission
limitations or standards. As currently cited, EPA finds no
substantive standards. If the San Joaquin Valley Unified Air
Pollution Control District's Air Pollution Rules and Regulations
contain the standards, then these should be cited as ARARs.
Corrective Action: Revise the section accordingly.
b. California Safe Drinking Water Act
This ARAR should remain in the state table. However, the Health
and Safety Code and the CCR Title 22 citations should clearly
identify which sections of the code and regulations are being
identified as ARARs.
Corrective Action: Revise the citation accordingly.
C. CCR, Title 23, Chapter 15
EPA's position remains the same as articulated in its comments
dated June 7, 1993 and July 8, 1993, i.e. , Chapter 15 is not an
ARAB.
Corrective Action: Delete this section.
d. Porter Cologne Water Quality Control Act
EPA's position remains the same as articulated in its comments
dated June 8, 1993 and July 7, 1993, i.e. , the identified sections
of Porter Cologne are not an AKAR.
Corrective Action: Delete this section.
e. Water Quality Control Plans
EPA has identified in its comments dated July 7, 1993, the
sections of the Basin Plan that it agrees are ARARs. The Citation
section in Table 10.2-2 should reference the applicable plan: The
Water Quality Control Plan for the Central Valley Regional Water
Quality Control Board, Second Edition, The Sacramento-San Joaquin
Delta Basin (Basin 5B) . Additionally, the Citation section should
also identify the particular portions of the Basin Plan that are
ARARs.
Corrective Action: Include those sections of the Basin Plan that
have been identified as substantive provisions. Revise the
Citation accordingly.
f. Resolution No. 68-16
EPA and the Board agree that this is an ARAR and should remain in
the state table. However, the comment section should be revised
EPA/R9 July 28, 1993 5/7
