Impacts may include odor, dust, <br /> noise, vectors and pesticide applications. These existing uses should be protected during the <br /> interim phases of development. Tracy should consider a "Right to Farm" Ordinance such as <br /> adopted by the County and other cities as a mitigation measure to protect these operations from <br /> nuisance complaints. The chart on page 273 indicates the largest measured ambient noise level <br /> came from farm machinery operation. <br /> Page xl, M 56.1: This mitigation does not seem to be realistic nor enforceable. Refer to <br /> comment above. The San Joaquin County Agricultural Commissioner controls and enforces uses <br /> of pesticides in the county. <br /> Pages xliii- xlviii: Regarding water in general, the EIR assumes that water rights for municipal <br /> and industrial (M & I) uses can be converted from agricultural uses. The EIR should further <br /> discuss the possibilities for increasing M & I uses based upon a declining groundwater basin, <br /> agriculture versus urban water rights, and contractual water allotments that are subject to <br /> reductions during drought conditions. Is 15 mgd from Delta Mendota and another 28 mgd from <br /> the California Aqueduct realistic possibilities given the water crisis in the entire State? How will <br /> the groundwater basin be impacted should all domestic water have to be pumped from city wells <br /> during drought conditions? <br /> • <br /> A Division of San Jwquin County Health tare SerncC 10 <br />
