In this letter, AGE notified the EHD that West Clay Property had <br /> notified the Underground Storage Tank Cleanup Fund (USTCF) `that future reimbursements <br /> and claim authority would be assigned to the current property owner KRC" (Knife River <br /> Corporation). AGE also informed the EHD that the USTCF owed KRC over $40,000.00 for <br /> expenses incurred to date. As a result, "AGE requests a suspension of the directive for a <br /> feasibility study and sampling until the USTCF claim authority has been assigned to the <br /> current property owner KRC.' <br /> The EHD has viewed online Office of the Assessor Information System (OASIS) for San <br /> Joaquin County. OASIS indicates that DDS Company Corp, owned by West Clay Properties, <br /> is the property owner of this site, and not KRC. For the EHD to name KRC a responsible <br /> party, you must provide documentation to this agency confirming that KRC is the current <br /> property owner. <br /> If or when the USTCF will transfer the claim authority for this site from West Clay Property to <br /> KRC is uncertain. As first stated by letter dated 15 September 2009, "the EHD cannot <br /> indefinitely suspend work on your site, or any other sites, as the EHD is responsible to keep <br /> sites moving toward closure while protecting human health and groundwater." Nearly three <br /> years have passed since the EHD had directed you by letter dated 19 May 2009 to submit a <br /> feasibility study for the 'Underground Storage Tank No. 3' area. The EHD denies the request <br /> to suspend the directive to submit a feasibility study. Instead, the EHD directs that the <br /> feasibility study, that includes resource requirements of each technology for cost <br /> effectiveness, be submitted to this department within thirty days of the date of this letter. <br /> By letter dated 19 December 2011, the EHD had greatly reduced the sampling/monitoring and <br /> analysis schedule for this site. This included the discontinuation of sampling 23 monitoring <br /> wells associated with this site.
