On <br /> the eastern fence line two piles of human waste covering an approximate area of 1x2 <br /> feet were observed. <br /> Investigate and abate contamination under the oversight of the appropriate lead agency. <br /> Immediately contain, clean up and dispose of the waste at an authorized, permitted <br /> location. Submit copies of hazardous waste manifests/disposal records to the EHD <br /> within 30 days. <br /> 3. Failure to Determine if a Waste is a Hazardous Waste (CA Code of Regulations <br /> 66262.11) <br /> 3-5 approximately 1x1 foot dark stains, that appeared to be oil, were observed in various <br /> locations around the dirt lot. Along the north side of the fence, near the northeast corner, <br /> dark staining was observed covering an approximate area of 10x5 feet. Staining <br /> appeared to be oil. Approximately 15 feet from the northern boundary of the property <br /> two standing puddles of liquid were observed. One puddle contained a green colored <br /> fluid approximately 1x2 feet in size. The other puddle had an oily sheen and covered an <br /> approximate area of 1 x2 feet. <br /> Any person who generates a waste shall determine if the waste is a hazardous waste. <br /> Immediately make a hazardous waste determination for the stained areas of dirt, green <br /> puddle and oily puddle of liquid and manage it according to Title 22 hazardous waste <br /> regulations. Submit a statement and supporting documentation explaining how this <br /> waste was managed. <br /> The results of the Soil Waste investigation revealed that there was a front-end loader onsite. <br /> Also, there was a large pile of concrete and an area that appeared to be subject to sub-surface <br /> disposal of solid waste. <br /> 4. Public Resources Code (PRC), Section 44002 (a) (1) <br /> 5. San Joaquin County Ordinance (SJCO), Title 5, Chapter 4, Section 5-2400; <br /> Accumulation of refuse, waste, and filth is prohibited, Chapter 4, Section 5-2401; <br /> Disposal on premises, Chapter 6, Section5-2600; Disposal area permit required. <br /> According to the PRC, Section 45000, 45005, and 45011, this department has the <br /> authority to issue an administrative order requiring the owner of a property to take <br /> corrective action as necessary to abate a nuisance, cease any illegal action, and <br /> establish a time schedule that the site shall be brought into compliance. <br /> Effective immediately cease and desist all unauthorized disposal of solid waste onto the above <br /> referenced property. Submit a plan to the EHD to remove all unauthorized solid waste from this <br /> location within 14 days of receipt of this letter. The plan needs to explain how the waste will be <br /> taken to an approved permitted disposal site or recycling facility, within 30 days of receipt of this <br /> notice. Failure to respond to this notice may result in further legal action. <br /> 2of3 <br />
