PUBLIC HEARING • • -2- A <br /> KINDER MORGAN ENERGY PARTNERS,L.P.THROUGH ITS OPERATING PARTNER SFPP,L.P. <br /> HOLT PETROLEUM RELEASE SITE <br /> SAN JOAQUIN COUNTY <br /> The hearing will not be conducted according to the technical rules of evidence. The Board will <br /> accept any evidence or testimony,which is reasonably relevant. <br /> Participants in the hearing are either designated parties or other interested persons. Only <br /> designated parties will have the right to cross-examination, and only other designated parties <br /> may be cross-examined. Interested persons -i.e., nondesignated parties - do not have a right to <br /> cross examination,but may ask the Board to clarify previous testimony. Interested persons may <br /> also be asked to clarify their testimony at the discretion of the Board. The designated parties for <br /> this hearing are as follows: <br /> Staff of the Central Valley Regional Board <br /> • Kinder Morgan Energy Partners <br /> • Persons directly affected by the discharge <br /> All other persons wishing to testify or provide comments are interested persons and not designated <br /> parties. Such interested persons may request status as a designated party for purposes of this <br /> hearing by submitting such request in writing to the Board no later than 22 September 2000. The <br /> request must explain the basis for status as a designated party and in particular how the person is <br /> directly affected by the discharge. <br /> All interested persons may speak at the Board hearing, and may orally summarize their written <br /> submittals. Oral testimony will be limited in time by the Board Chair(typically no more than 15 <br /> minutes for designated parties and 3 minutes for other interested persons). Oral testimony must <br /> be relevant. Regional Board staff will be allowed additional time to summarize comments that <br /> have been received regarding this matter. Groups of speakers will be expected to select a <br /> spokesperson and not be repetitive. Cross-examination by any party shall be limited by the Board <br /> Chair(typically no more than 10 minutes). <br /> After considering the evidence, testimony, and comments, the Board may adopt the proposed <br /> renewed NPDES Permit. Any person aggrieved by the action of the Board may petition the State <br /> Water Resources Control Board to review the action within 30 days of the action. <br /> Anyone having questions on the proposed Renewed NPDES Permit should contact Mary Serra at <br /> (916) 255-3082.
