There are no financial assurances provided for closure and post <br /> closure of the hazardous waste facilities as required in 40CFR <br /> 265.143 and 265.145 per Sections 25245 and 25159.6 of the <br /> Health and Safety Code. <br /> 12. The draft Contingency Plan does not contain the following: <br /> a. Names of Emergency Coordinators, addresses and phone numbers. <br /> b. Indication that copies of the plan were sent to listed agencies. <br /> c. Require notification to the Department of Health Services in <br /> the event of a threatened or actual hazardous waste emergency. <br /> d. Provide for amendments to the plan. <br /> e. Designate which outside agency or department is in charge in <br /> case two similar function agencies provide assistance, <br /> i.e. , two police or fire departments. <br /> f. Provide for sending the Department of Health Services a written <br /> report outlining what types and amounts of waste were involved, <br /> off-site discharges, injuries, repairs completed, equipment <br /> decontaminated and notice of readiness to resume hazardous <br /> waste activities as required in Sections III, 12 to 17 of the <br /> ISD; Sections 66520(g) , 66525(g) (1) of the C.A.C. and 40 CFR <br /> 265.37, .51, .52, .53, .54, .55, .56. <br /> 13. Facility has discharged solvents, greases, oils and trichloroethyl- <br /> ene to dry wells wherein same has been detected in groundwater <br /> on the site and therefore has not insured that the operation of <br /> the facility will not imperil public health, safety, wildlife or <br /> the environment as required in Section I, 1,(a) of the ISD. <br /> 14. The hazardous waste storage tank used to store chromic acid/sulfuric <br /> acid plating waste solution was not: <br /> a. Provided with a spill confinement structure sufficient to hold <br /> the entire contents of the tank plus sufficient freeboard. <br /> b. Certified by an engineer registered in California that the <br /> tank and its appurtenances are structurally sound and of <br /> adequate construction for the intended use. <br /> c. .larkcd with the appropriate ITFPA 'label as required in Section II, <br /> 2 of the ISD and Sections 66381(a) of C.A.C. <br /> 15. Spills of trichloroethylene to the ground have occurred in several <br /> test sites throughout the facility outside of the hazardous waste <br /> facility areas in violation of Section 66490(a) of the C.A.C. <br /> You are directed to clean up all spills of trichloroethylene immediately, <br /> as well as, cut off the entry ways to all dry wells and decontaminate same. <br /> Regarding other violations: <br /> Section 66328(d) C.A.C. states: "If corrections are needed, the operator <br /> shall provide to the Department a written plan of correction which states <br /> the actions to be taken and the expected dates of completion." <br />
