I ' m not getting the whole picture , what makes Shell think they can just stop remediation ? ? <br /> There is no guarantee that they will get an NPDES permit , actually it sounds doubtful . <br /> What surface water are they proposing to discharge to ? <br /> >>> Jim Barton 04 / 14 / 04 11 : 58AM >>> <br /> Thanks for your phone call , Margaret . Attached is the NPDES general permit . Please note <br /> finding # 13 which says local agencies have the authority to prohibit , restrict , or control <br /> the discharge to their local storm water collection and their conveyance facilities <br /> ( wastewater ? ) . <br /> Brian , Margaret reported that Shell stopped remediation at the above -named site in October <br /> 2003 because the effluent from the pump & treat system contains detectable MtBE , which is <br /> now banned from being introduced into sewers by permits issued by the City of Stockton . <br /> Shell said that they would stop treating groundwater until we issue them an NPDES permit . <br /> I told Margaret that Shell would not get an NPDES permit if they would be in violation of <br /> a local ordinance ( I knew this fact from writing the Riverbank Army Ammunition Plant <br /> permit in 2000 . ) . Margaret says that they would like to tell Shell to resume groundwater <br /> treatment , even if it means hauling the " treated water " to an offsite approved treatment <br /> facility . I questioned why Shell is having problems with the treatment system , in light <br /> of the many smaller companies which are meeting the discharge requirements with the <br /> available technology under various permits . <br /> What do you think? <br /> Should we cc : ' this email to- the attorneys involved in the MtBE lawsuit ? <br /> Thanks . <br /> Jim <br /> James L .
