P03-215 This will`acknowledge receipt of your amended petition dated March 25, 2003 and received by our office on'March 27 2003. You have asked the State Water Resources Control Board(State Board)to review the decision made by San Joaquin County(County)to name USA Petroleum Corporation responsible for investigation and cleanup of the subject site. A Notice of Responsibility(NOR)was issued to USA Petroleum(Petitioner) on January 31, 2003 because they are the current property owners. Article 11, Chapter 16,Title 23, California Code of Regulations (corrective action regulations) gives four definitions for a responsible party. The third definition applies in this case—"any owner of property where an unauthorized release of a hazardous substance from an underground storage tank has occurred." The NOR was accompanied by a cover letter that indicated the other responsible party for this site is Exxon Mobile. As you know,Exxon Mobile has been involved in a cleanup project at this site for a number of years. The County has never issued a"no further action" letter; consequently,it is still considered an active site. The County considers both Exxon Mobile and the Petitioner jointly responsible for site investigation and cleanup. I believe the issue in the petition(removal of Petitioner as a responsible party)has now been resolved. If you wish to continue with the petition, an amended petition must be submitted within 30-days from`the date of this letter. The amended petition must raise additional issues for State Board review.
