• REC9VE0 FES 1 0 1997 <br /> ACCESS AGREEMENT COPY <br /> This Access Agreement (The "Agreement") is made as of February 6, 1997, by <br /> and among George and Mei Teranishi and Muriel Jones (31448 South Hwy 33, Tracy, The <br /> "Owners") in the following context: <br /> RECITALS <br /> A. George and Mei Teranishi are the owners of certain real property, <br /> commonly referred to as 1600 West Durham Ferry Road, in Tracy, California (The "Property"), <br /> situated in the State of California, as shown on the map contained in Exhibit A, which is attached <br /> hereto and by this reference made a part hereof. <br /> B. The Owners own The Property immediately southeast of the Muriel Jones <br /> property, which is immediately northwest of The Property. <br /> C. This Agreement is entered into in order for George and Mei Teranishi, <br /> through its consultants, Geological Technics Inc. (GTI), to continue performance of an <br /> environmental assessment (the "Assessment"), as recommended in a report prepared by GTI <br /> entitled Additional Site Assessment Work Plan and its Addendum and to undertake any other <br /> activity considered necessary or advisable to mitigate any environmental problems identified <br /> during the Assessment as resulting from the operation of George and Mei Teranishi's facility <br /> (the "Related Activities"). <br /> NOW, THEREFORE,the parties agree as follows: <br /> 1. Grant: The Owners hereby grant George and Mei Teranishi, its <br /> contractors and subcontractors, permission to Access the borehole/monitoring well locations and <br /> work area associated with the wells (the "Designated Area") of BLIC land as contained in <br />
