George and Mei Teranishi/MUrieWes • Access Agreement February 6, 1997 Page 2 Exhibit A, for purposes of undertaking and completing the Assessment and the Related Activities, as herein described below. 2. Assessment: Assessment includes completing the additional testing and analysis as recommended in a work plan (Additional Site Characterization Work Plan) prepared by GTI dated January 29, 1996 and Addendum to Additional Site Characterization Work Plan dated January 20, 1997. Such recommendation calls for drilling of monitoring wells, in which the specific locations are shown on the attached map. 3. Related Activities: Related Activities include, but are not limited to, the following: (1) monitoring the progress of any subsequent remedial work (including, but not limited to, groundwater monitoring); (2) conducting subsequent investigations relating to contamination identified as a result of the Assessment; and (3) any other activity considered necessary or advisable for proper and complete performance of any remedial work. 4. Access: (a) GTI shall give notice to The Owners prior to Accessing the Designated Area for purposes of commencing performance of the Assessment. (b) After notice has been provided pursuant to subparagraph (a) above, persons authorized by George and Mei Teranishi or GTI ("Authorized Persons") may Access well locations for purposes of performing the Assessment. At any time, without notice to The Owner, Authorized Persons may Access the Designated Area for purposes of inspecting, observing, maintaining or monitoring conditions (including, but not limited to, groundwater monitoring wells) on the Designated Area related to the Assessment or the Related Activities. 5. Applicable Law: George and Mei Teranishi shall undertake and complete the Assessment and any Related Activities in full compliance with all laws and regulations applicable to the Assessment and the Related Activities ("Applicable Law").
