r responsible for the cost of any associated premiums but <br /> shall be named as an additional insured. Consultant shall <br /> be responsible for the cost of any assoi::iated premiums. <br /> Consultant shall be responsible for any third party claims <br /> related to the execution of work described herein, with the <br /> exception of claims filed by Ruiz Grocery employees. Proof <br /> of such insurance shall be furnished to Ruiz Grocery prior <br /> to the start of work. <br /> B . Work shall be performed in a manner which will not require <br /> the cessation of business at the site unless absolutely <br /> necessary or dictated by the PHS/EHD. <br /> 9 . Consultant shall provide a copy of consultant's schedule of <br /> charges with any bid submitted. The schedule of charges <br /> shall include: (a) hourly rates for personnel classifica- <br /> tions employed by consultant; (b) unit charges for common <br /> supplies and equipment used in corrective action work; and <br /> (c) multipliers used when charging any other direct expenses <br /> (e.g. subcontractors) . <br /> 10. If vapor extraction is the method proposed in the bid, the <br /> per-day cost of installation of the wells, or a per-unit <br /> cost per well shall be included in the bid. <br /> 11. Consultant understands that Ruiz Grocery reserves the right <br /> to reject any or all bids without notice or cause. Ruiz <br /> Grocery retains the right to solicit and accept additional <br /> bids as necessary in its judgment. All bids are due within <br /> ten days of the cover letter. <br /> 12. Consultant understands that Ruiz Grocery intends to seek <br /> reimbursement for the subject work from the Underground <br /> Storage Tank Cleanup Fund administered by the State Water <br /> Resources Control Board, and will agree to respond to any <br /> reasonable inquiry from the agency regarding any claim sub- <br /> mitted by Ruiz Grocery. Invoices must conform with the <br /> recommended minimum guidelines of the State Water Resources <br /> Control Board. <br /> 13 . Consultant understands Ruiz Grocery will contact references <br /> and otherwise conduct an investigation to determine to the <br /> satisfaction of Ruiz Grocery that consultant has the techni- <br /> cal and financial capabilities to perform the requested work <br /> and has established goodwill with other clients and regula- <br /> tory agencies. <br /> 14 . A workplan for interim remediation must be submitted to <br /> PHS/EHD by September 20, 1993. Therefore, this workplan <br /> must be completed and submitted to Neumiller & Beardslee for <br /> review by September 13, 1993. <br /> E.
