San Joaquin County <br /> Environmental Health Department <br /> 1868 East Hazelton Avenue, Stockton, California 95205-6232 <br /> Telephone:(209)468-3420 Fax:(209)468-3433 Web:www.sogov.org/ehd <br /> Hazardous Materials Program Inspection Report <br /> Facility Name: Facility Address: Date: <br /> PRIMA FRUTTA PACKING 16461 E COMSTOCK RD, LINDEN July 02, 2019 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 7 HSC 25505(a)(3) Failed to establish and/or submit emergency response procedures for a release or threatened <br /> release. <br /> The emergency response procedures were not completed with all required information. <br /> The business plan did not contain the phone number to the SJC Environmental Health Department/CUPA <br /> (209)468-3420 for spill/releases notification. <br /> A business plan shall include the following emergency response procedures for a release or threatened release of <br /> hazardous materials, including, but not limited to,the following: <br /> -immediate notification of local emergency personnel and the Environmental Health Department(EHD) <br /> -procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment <br /> -evacuation plans and procedures, including immediate notice,for the site <br /> Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, upload the <br /> correct or updated information, and submit to the EHD for approval. <br /> This is a Class II violation. <br /> 1010 The facility failed to register the Methyl Bromide in the CalARP Program.The facility stores 4,025 pounds of Methyl <br /> Bromide onsite without a CalARP program. Robert Wyman stated that they will keep the quantity for the Methyl <br /> Bromide below 1000 pounds so they do not have to register the process with CaIARP. Submit a certified/signed <br /> letter to SJC EHD stating that the facility will keep the Methyl Bromide below the CalARP threshold quantity(1,000 <br /> lbs)or register the process with the CalARP Program. <br /> This is a minor violation. <br /> Overall Inspection Comments: <br /> Onsite to conduct a hazardous material business plan inspection. There were four violations during the <br /> inspection. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a <br /> statement documenting the corrective actions that have been or will be taken for each violation, and any <br /> supporting paperwork, by August 01, 2019. <br /> General Notes: <br /> "Federal Hazard Categories" section for the chemical inventory have not been updated per 2018 requirement. <br /> The submitted business plan contains obsolete data Elements and should be updated and/or replaced with <br /> valid Data Elements before submitting your inventory. The Hazard Categories was emailed to Stephanie Ballard. <br /> Label the sulfuric acid tank <br /> If the facility brings any other reportable chemicals to the site, they must be reported within 30 days.
