As of this date, there have been no annual ground wafer <br /> reports submitted to EHD since the last one dated November 1, 1999, for a <br /> sampling event held on September 23, 1999. The closure report submitted to <br /> EHD in April 2002 included only one ground water sampling event since 1999, <br /> February 5, 2002. No ground water sampling reports have been submitted since. <br /> On May 23, 2002, EHD commented on your request for closure and denied the <br /> No Further Action based on the lack of contamination delineation and the <br /> presence of high levels of dissolved petroleum below the site. EHD required a <br /> work plan to be submitted to continue your required investigation. EHD did not <br /> set a due date for the work plan to allow the Trust time to budget the time and <br /> money needed. Since a work plan has not been submitted as of this date, you <br /> have failed to meet the requirements of EHD. <br /> California Code of Regulations (Section 2729.1) requires that all investigative <br /> and remedial data for leaking UST sites to be electronically submitted to <br /> Geotracker. A review of the Geotracker database revealed no data has been <br /> submitted and the site does not appear to have established a global identification <br /> number. <br /> You are hereby directed to conduct quarterly ground water monitoring and <br /> reporting starting immediately. The next quarterly report is due at EHD <br /> April 22, 2005 and is to include ground water data from the first quarter- <br /> 2005. Refer to EHD's May 23, 2002 correspondence for EPA Methodology for <br /> the analytical requirements. <br />
