SPILL PREVENTION CONTROL AND COUNTERMEASURES PLAN <br /> VALLEY PACIFIC PETROLEUM SERVICES <br /> ESCALON FACILITY <br /> 1.0 CERTIFICATION REQUIREMENTS [40 CFR 112.6(a)(b) and (c)] <br /> If a facility has greater than 10,000 gallons of aboveground oil storage capacity, the facility's SPCC Plan <br /> must be reviewed and certified by a Professional Engineer. The facility may prepare a self-certified SPCC <br /> Plan if the following eligibility criteria are met: <br /> • The facility must have 10,000 gallons or less in aggregate aboveground oil storage capacity; and <br /> • For 3 years prior to plan certification, or if it has operated for less than 3 years, the facility must <br /> not have had: <br /> o A single discharge of oil to waters of the state exceeding 1,000 gallons or, <br /> o Two discharges of oil to navigable waters of the United States each exceeding 42-gallons <br /> (within any 12 month period). <br /> At Valley Pacific Petroleum Services' (VPPS) Escalon Facility (Facility), the total aboveground oil <br /> storage capacity exceeds 10,000 gallons; therefore, this SPCC Plan is required to be reviewed and <br /> certified by a Professional Engineer. <br /> 2.0 GENERAL REQUIREMENTS FOR SPILL PREVENTION, CONTROL, AND <br /> COUNTERMEASURES [40 CFR 112.71 <br /> 2.1 MANAGEMENT APPROVAL OF SPCC PLAN <br /> Management approval of the SPCC Plan is contained on page iii of this SPCC Plan. <br /> 2.2 GENERAL APPLICABILITY [40 CFR 112.7(a)(1) and(2)] <br /> This SPCC Plan is in general conformance with Title 40,Code of Federal Regulations,Part 112(November <br /> 5,2009).The section titles include reference to the applicable sections of 40 CFR Part 112.The regulations <br /> require the SPCC Plan to be prepared in the sequence of Part 112.7 or to provide a cross-reference to the <br /> requirements of this Part. This SPCC Plan follows the sequence of Part 112.7, Subparts A and B, and 40 <br /> CFR 112.8 and 112.12, and also includes cross-reference matrix in Appendix 9. <br /> According to 40 CFR Facilities are required to have a SPCC Plan if. <br /> • A facility uses or stores oil, but does not transport petroleum as their primary purpose. Such <br /> facilities could include industrial, commercial, agricultural, or public facilities. <br /> • A facility has an aboveground oil storage capacity of greater than or equal to 1,320 gallons on site <br /> (storage capacity is calculated by adding any container that is 55 gallons or greater) and/or an <br /> aggregate underground oil storage capacity greater than or equal to 42,000 gallons excluding <br /> Regulated Underground Storage Tanks. <br /> • A facility could reasonably be expected to discharge oil to navigable waters of the United States or <br /> adjoining shorelines in quantities that may be harmful. <br /> The Facility total oil storage capacity for aboveground storage is over 1,320 gallons; therefore, SPCC <br /> regulations apply. <br />
