711 Materials, Inc. <br /> ALTA <br /> Spill Prevention, Control and Countermeasure Plan ENVIRONMENTAL <br /> 4.0 INTRODUCTION <br /> Ref:40 CFR 112.1 <br /> 4.1 Regulation Background <br /> In 1973, the United States EPA issued the Oil Pollution Prevention Regulation, which is <br /> codified in Title 40 CFR Part 112, to address the oil spill prevention provisions contained in <br /> the Clean Water Act of 1972. The regulation forms the basis of EPA's oil SPCC program, <br /> which seeks to prevent oil spills from certain aboveground and underground storage tanks <br /> discharging to the navigable waters of the United States. The regulation was most recently <br /> amended in November 2009, requiring that a facility incorporate elements of the new <br /> regulations into its SPCC Plan. <br /> In particular, the regulation applies to non-transportation-related facilities that could reasonably <br /> be expected to discharge oil in quantities that may be harmful into or upon the navigable <br /> waters of the United States, including tributaries or adjoining shorelines, and <br /> 1) Has an aggregate aboveground oil storage capacity of more than 1,320 gallons; or <br /> 2) Has an aggregate underground oil storage capacity of more than 42,000 gallons. <br /> For the purposes of this regulation "oil" is defined as "oil of any kind or in any form, including, <br /> but not limited to: fats, oils or greases of animal, fish or marine mammal origin; vegetable <br /> oils, including oils from seeds, nuts, fruits or kernels; and, other oils and greases, including <br /> petroleum, fuel oil, sludge, synthetic oils, mineral oils, oil refuse or oil mixed with wastes other <br /> than dredged spoil." EPA's interpretation of this definition includes crude oil, petroleum, <br /> petroleum-refined products and asphalt oil. <br /> Storage tanks included in a facility's oil capacity calculations include all containers with a <br /> capacity of 55-gallons and above, e.g.: <br /> • Any aboveground container, including operating equipment, i.e., generators with fuel <br /> tanks, transformers (owned and operated by the Facility), hot oil heater, bulk containers <br /> on trucks (not including fuel used for motive power of the truck); <br /> • Any partially buried tank; <br /> • Any completely buried tank; and <br /> • Any container that is used for standby storage, for seasonal storage, or for temporary <br /> storage, or not otherwise permanently closed. <br /> Alta Environmental 5 <br /> BASR-19-8895 <br /> July 3, 2019 <br />
