711 Materials, Inc.
ALTA
Spill Prevention, Control and Countermeasure Plan ENVIRONMENTAL
4.0 INTRODUCTION
Ref:40 CFR 112.1
4.1 Regulation Background
In 1973, the United States EPA issued the Oil Pollution Prevention Regulation, which is
codified in Title 40 CFR Part 112, to address the oil spill prevention provisions contained in
the Clean Water Act of 1972. The regulation forms the basis of EPA's oil SPCC program,
which seeks to prevent oil spills from certain aboveground and underground storage tanks
discharging to the navigable waters of the United States. The regulation was most recently
amended in November 2009, requiring that a facility incorporate elements of the new
regulations into its SPCC Plan.
In particular, the regulation applies to non-transportation-related facilities that could reasonably
be expected to discharge oil in quantities that may be harmful into or upon the navigable
waters of the United States, including tributaries or adjoining shorelines, and
1) Has an aggregate aboveground oil storage capacity of more than 1,320 gallons; or
2) Has an aggregate underground oil storage capacity of more than 42,000 gallons.
For the purposes of this regulation "oil" is defined as "oil of any kind or in any form, including,
but not limited to: fats, oils or greases of animal, fish or marine mammal origin; vegetable
oils, including oils from seeds, nuts, fruits or kernels; and, other oils and greases, including
petroleum, fuel oil, sludge, synthetic oils, mineral oils, oil refuse or oil mixed with wastes other
than dredged spoil." EPA's interpretation of this definition includes crude oil, petroleum,
petroleum-refined products and asphalt oil.
Storage tanks included in a facility's oil capacity calculations include all containers with a
capacity of 55-gallons and above, e.g.:
• Any aboveground container, including operating equipment, i.e., generators with fuel
tanks, transformers (owned and operated by the Facility), hot oil heater, bulk containers
on trucks (not including fuel used for motive power of the truck);
• Any partially buried tank;
• Any completely buried tank; and
• Any container that is used for standby storage, for seasonal storage, or for temporary
storage, or not otherwise permanently closed.
Alta Environmental 5
BASR-19-8895
July 3, 2019
