The Letter included a copy of the 11 April 2003 Additional Soil and Ground Water <br /> Investigation Report(Report) submitted by Advanced GeoEnvironmental, Inc. The Letter <br /> requests consideration of reclassifying Herman&Helen's Marina as an underground storage tank <br /> (UST) site. The Report recommends additional investigative work to delineate the extent of <br /> pollution and determine the source of pollution near monitoring well MW-6. Ms. Devra Lewis <br /> of my staff concurred with these recommendations in her 21 April 2003 letter. <br /> On 2 June 2003, the UST Cleanup Fund(Fund) sent you a letter,which is attached, stating it <br /> tentatively concludes that most of the methyl tertiary butyl ether(MTBE) did not originate from <br /> the USTs and that it would prefer to have more information prior to making a final determination <br /> on future reimbursements from the Fund. <br /> As my staff has discussed with you and is noted in the Letter, when there is sufficient data to <br /> make a determination of the source of the petroleum pollution, or to determine a percentage <br /> attributable to the USTs, we will re-evaluate the classification of the site. Based on the <br /> recommendations in the Report, it is clear that there is not enough data to determine the <br /> percentage of pollution attributable to the USTs. <br /> Furthermore, I have concerns regarding the concentrations of MTBE and other petroleum <br /> pollution entering nearby surface waters. Remedial activities must be implemented to prevent <br /> continued releases of petroleum pollution into surface waters,which threaten beneficial uses and <br /> are a violation of Federal law. Please continue to work with my staff to start an interim remedial <br /> action and determine the percentage of pollution attributable to the former USTs. <br /> California Environmental Protection Agency <br /> Zoo Recycled Paper <br /> The energy challenge facing California is real.
