EI Dorado St. <br /> Stockton, CA 95202 <br /> Enclosed please find a copy of Senate Bill 1248 and the Department of Toxic Substance Control <br /> (DTSC) fact sheet. These documents form the basis for a local agency (San Joaquin County Public <br /> Health Services, Environmental Health Division, PHS-EHD) to supervise the remedial action at a <br /> release site, establish cleanup goals for the site, and certify that the cleanup goals were accomplished. <br /> The agreement that is mentioned is to be constructed by you, your consultant, and PHS-EHD. We will <br /> take into consideration the lateral and vertical extent of the contamination, the constituents dissolved in <br /> the groundwater, and those remaining in the soil. The dangers to the public health will be evaluated <br /> and the costs of the cleanup will be estimated. Only when this agreement is satisfactory to us will it be <br /> forwarded to DTSC and the Central Valley Regional Water Quality Control Board (CVRWQCB) for their <br /> ten (10) day notification/comment period. <br /> If no objections are reported by DTSC or the CVRWQCB, PHS-EHD and you will sign and enter into <br /> the agreement. Work may begin immediately after this. <br /> Your recently submitted workplan to place a new monitoring well and advance more soil borings may <br /> begin now without an agreement, but you should know that should conditions at the site indicate that <br /> the groundwater plume and contaminated soil extent are not as large as a problem as once thought, <br /> PHS-EHD will still be unable to issue a closure letter without a signed agreement under SB-1248. <br /> If you do not wish to enter into an agreement with PHS-EHD, current levels of groundwater <br /> contamination will require your site to be referred to the CVRWQCB. <br /> I hope this clarifies our position on your site and gives you a better understanding of the procedures <br /> involved with Senate Bill 1248.
