Phillips of Mayall, Hurley, Knutsen, Smith&Green <br /> Law Offices dated April 18, 2005 and received by the Fund on July 20, 2005. The letter states it <br /> will no longer be necessary for the Fund to process the claim application for Edward Ah Tye <br /> (received by the Fund on April 19, 2005) but requests that the Fund hold the application in <br /> abeyance in case foreclosure proceedings on the subject property are reinstated in the future. <br /> As requested, the Fund will not proceed with the review of the above subject claim. However, <br /> instead of holding the claim application in abeyance, the Fund will record this claim as ineligible <br /> for placement on the Priority List at this time. If in the future claimant should decide to pursue <br /> this claim application, claimant must submit a letter to the Fund Manager as outlined below, and <br /> request the Fund to re-open and continue with the review of claimant's application. <br /> If you disagree with this Staff Decision, you may appeal to the Division Chief pursuant to <br /> Section 2814.1 of the Petroleum Underground Storage Tank Cleanup Fund Regulations. If you <br /> would like review of the decision by the Fund Manager, please submit your request along with <br /> any additional documentaiion to: — <br /> Ronald M.
